This website is operated by MySafetyPrep ("we", "us", "our"), a digital learning provider based in British Columbia, Canada. Throughout these Terms, "MySafetyPrep", "we", "us" and "our" refer to the same entity.

By accessing or using this website — including browsing, purchasing, or using any product or service — you ("you", "the user", "the customer") confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full.

If you do not agree to these Terms, you must not access or use this website. Your continued use of the website following any updates to these Terms constitutes your acceptance of those changes.

Products and Services

MySafetyPrep offers the following categories of digital products and services:

All products are delivered digitally. Access is granted immediately following confirmed payment. No physical products are shipped.

We reserve the right to modify, suspend, or discontinue any product or service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.

No Guarantee of Certification or Exam Success

MySafetyPrep provides educational and exam preparation materials only. Our products are not official certifications, qualifications, licences, or credentials of any kind.

Completion of our exam preparation materials does not guarantee that you will pass any certification exam. Exam outcomes depend on individual knowledge, preparation, and performance on the day of the exam. MySafetyPrep makes no warranty or representation that use of our materials will result in a passing exam score.

Our ethics courses and CPD packages are designed to meet specific regulatory requirements. However, it is your responsibility to confirm that a course meets your specific regulatory body's requirements before purchasing. MySafetyPrep is not responsible for course rejection by any regulatory body arising from a failure to confirm suitability prior to purchase. Contact us before purchasing if you are unsure.

Access, Accounts and Permitted Use

Access to purchased products is granted to the purchasing individual only. Your account and access credentials are personal and non-transferable. You may not share, sell, sublicense, or transfer access to any product to any other person.

Access to online courses and exam preparation products is provided for a period of 6 months from the date of purchase. Extensions may be granted at our discretion upon request at no additional charge. Downloadable products (PDFs, Word documents) have no access expiry once downloaded.

You agree to use our products solely for your own lawful personal or professional development purposes. You may not:

Payment

All prices are listed in Canadian dollars (CAD). Payment is processed securely through Stripe. We accept all major credit cards. By providing payment information you represent that you are authorised to use the payment method provided.

Access to purchased products is granted upon confirmed payment. We reserve the right to cancel any order at our discretion in cases of suspected fraud, abuse, or violation of these Terms, in which case a full refund will be issued.

If a chargeback or payment dispute is initiated by you or your financial institution for a purchase that does not qualify for a refund under our Refund Policy, we reserve the right to dispute the chargeback, provide documentation of your acceptance of these Terms, and pursue recovery of any associated fees.

All content on this website and within our products — including but not limited to study guides, practice questions, answer explanations, course materials, safety manual templates, safety plan templates, text, graphics, logos, and design — is the exclusive property of MySafetyPrep and is protected by Canadian and international copyright law.

Purchase of a product grants you a limited, non-exclusive, non-transferable licence to use the product for your own personal or professional development. This licence does not transfer ownership of the content to you.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any of our content except as follows:

However, exam blueprints and regulatory requirements change, and while we update our materials promptly, we cannot guarantee that all content reflects the most current requirements at all times. It is your responsibility to verify that our materials align with current requirements before relying on them.

Limitation of Liability

To the fullest extent permitted by applicable law, MySafetyPrep, its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our products or services, including but not limited to:

In any event, our maximum aggregate liability to you for any claim arising from your use of our products or services shall not exceed the total amount paid by you to MySafetyPrep for the specific product or service giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless MySafetyPrep, its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Termination of Access

We reserve the right to suspend or terminate your access to our website and products at any time, with or without notice, if we determine that you have violated these Terms or engaged in conduct that we consider harmful to MySafetyPrep or other users.

In cases of termination for cause (violation of these Terms), no refund will be issued. In cases of termination without cause at our discretion, a pro-rated refund may be issued at our discretion.

All provisions of these Terms which by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and indemnification — shall survive termination.

Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms, your use of our website, or any purchase from MySafetyPrep shall first be attempted to be resolved informally by contacting us at support@mysafetyprep.com. We will make every reasonable effort to resolve disputes promptly and fairly.

If informal resolution is not possible, you agree that any legal proceedings shall be conducted in the courts of British Columbia, Canada, and you consent to the personal jurisdiction of such courts.

Changes to These Terms

MySafetyPrep reserves the right to update, modify, or replace these Terms and Conditions at any time. The date of the most recent revision is shown at the top of this page.

It is your responsibility to review these Terms periodically. Your continued use of the website or our products following the posting of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the website and our products.

Taxes, Currency and Exchange Rates

All prices are listed in Canadian dollars (CAD). For customers outside Canada, your financial institution will apply its prevailing exchange rate at the time of purchase. MySafetyPrep is not responsible for any currency conversion fees, exchange rate fluctuations, or foreign transaction fees charged by your bank or card provider.

You are solely responsible for determining whether any taxes, duties, or levies apply to your purchase under the laws of your jurisdiction. MySafetyPrep collects and remits taxes as required under applicable Canadian law. If you are purchasing on behalf of a business or organisation, you are responsible for any applicable GST, HST, or other tax obligations.

Privacy and Personal Information

MySafetyPrep collects and processes personal information in accordance with applicable Canadian privacy legislation including the Personal Information Protection and Electronic Documents Act (PIPEDA) and the Personal Information Protection Act (PIPA) of British Columbia.

Personal information collected during account creation and purchase — including your name, email address, and payment information — is used solely for the purpose of providing our products and services, processing payments, and communicating with you about your account. We do not sell your personal information to third parties.

Payment information is processed by Stripe and is not stored on our servers. By purchasing from MySafetyPrep you consent to the collection and use of your personal information as described here and in our Privacy Policy.

Third Party Links and Services

Our website may contain links to third party websites, including BCSP, BCRSP, provincial regulatory bodies, and other external resources. These links are provided for your convenience only. MySafetyPrep has no control over the content, policies, or practices of third party websites and accepts no responsibility for them.

Links to third party websites do not constitute endorsement of those sites or their content. You access third party websites at your own risk and subject to their own terms and conditions.

Our payment processing is handled by Stripe. By completing a purchase you also agree to Stripe's terms of service. MySafetyPrep is not responsible for any issues arising from Stripe's processing of your payment beyond our reasonable control.

Corporate and Group Purchases

Where a purchase is made by an organisation, employer, or representative on behalf of one or more individuals, the purchasing entity agrees to these Terms on behalf of all end users. The purchasing entity is responsible for ensuring that all end users are aware of and comply with these Terms.

Each individual user requires their own separate access. Group purchases grant access to the specified number of individuals only — access credentials may not be shared beyond the agreed number of licensed users.

Corporate invoicing and group registration arrangements must be agreed in writing with MySafetyPrep prior to purchase. Contact us at support@mysafetyprep.com to arrange corporate registrations.

Force Majeure

MySafetyPrep shall not be liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, power outages, internet service disruptions, cyberattacks, government actions, or third party service failures.

In such circumstances we will make every reasonable effort to restore service as quickly as possible and will communicate with affected customers promptly.

Entire Agreement, Severability and Waiver

Entire agreement: These Terms and Conditions, together with our Refund Policy and Privacy Policy, constitute the entire agreement between you and MySafetyPrep with respect to your use of our website and products, and supersede all prior agreements, representations, and understandings.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any breach of these Terms shall not constitute a waiver of any subsequent breach.

No agency: Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and MySafetyPrep.

Prohibited Uses — AI, Scraping and Automated Access

You expressly agree not to use any automated means — including bots, scrapers, crawlers, scripts, or artificial intelligence tools — to access, extract, copy, or index any content from our website or products without our prior written permission.

You may not use our content — including practice questions, answer explanations, study guide content, or any other materials — to train, fine-tune, or otherwise develop any artificial intelligence model, machine learning system, or automated tool.

Violation of this section may result in immediate termination of access, legal action, and claims for damages. We reserve the right to take all available legal remedies against any party found to be scraping or unlawfully extracting our content.
